Terms & Conditions

Please read this Agreement carefully before scheduling service or joining a membership plan.

NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION. ARBITRATION AGREEMENTS ARE VALID AND ENFORCEABLE UNDER SECTION 8.01-581.01 OF THE CODE OF VIRGINIA.

If you contract with Virginia Appliance Repair LLC (“Virginia Appliance Repair”) to perform services for you (the “Customer”), the following Terms and Conditions of Service (“Agreement”) shall apply to all services performed and any parts, materials, or goods provided. It is the Customer's responsibility to review and understand this Agreement prior to the commencement of any work. Authorization for Virginia Appliance Repair to begin service, or to enroll in a Membership Plan, shall constitute full acceptance of all terms and conditions set forth herein.

Non-Refundable Diagnostic Fee

Virginia Appliance Repair charges a non-refundable service fee (the “Diagnostic Fee”) for all non-warranty service visits to the Customer's residence or place of business. The Diagnostic Fee will be disclosed prior to the service appointment and is intended to compensate Virginia Appliance Repair for travel, time, and professional diagnostic evaluation performed by a qualified technician.

By accepting service, Customer agrees that:

  1. The Diagnostic Fee is due and payable in full regardless of whether Customer elects to proceed with any recommended repairs; and
  2. In the event Customer approves the recommended repair, the Diagnostic Fee shall be applied toward the total cost of such repair.

Estimate

The estimate portion of the Service Order represents Virginia Appliance Repair's good-faith assessment of the parts and labor required to complete the repair (the “Price Quote”). By approving the estimate, Customer agrees to the scope of work and associated pricing.

Customer acknowledges that additional defects or conditions may be discovered during the course of service, which may require a revised estimate and additional authorization prior to continuation of work.

Parts and Deposits

Customer acknowledges that a deposit may be required prior to the ordering of parts.

Payment Terms and Collection Costs

Payment for all services rendered shall be due immediately upon completion of work unless otherwise agreed to in writing by Virginia Appliance Repair. Accepted forms of payment include cash, credit card, and check.

Any returned or dishonored payment shall be subject to a processing fee of $25.00. Customer agrees to be responsible for all costs incurred by Virginia Appliance Repair in the collection of unpaid balances, including but not limited to reasonable attorney's fees, court costs, and administrative expenses.

Any past due amounts shall accrue interest at a rate of eighteen percent (18%) per annum, or the maximum rate permitted by applicable law, whichever is less.

Customer Responsibilities

Customer agrees to:

Virginia Appliance Repair reserves the right to refuse, reschedule, or terminate service if conditions are deemed unsafe or inaccessible.

Appointment Policy

Appointments are scheduled within a service window and not for a specific arrival time.

Customer agrees to be available during the scheduled service window. Failure to be available, or late cancellation of an appointment, may result in additional service charges.

Limited Warranty

Virginia Appliance Repair warrants that all parts and labor provided shall be free from defects in material and workmanship for a period of ninety (90) days from the date of service or installation.

Virginia Appliance Repair's sole obligation under this warranty, and Customer's exclusive remedy, shall be limited, at the sole discretion of Virginia Appliance Repair, to the repair, replacement, or refund of the defective service or component.

This warranty shall not apply under any of the following conditions:

  1. Appliances used for commercial or industrial purposes;
  2. Cosmetic or non-functional components, including but not limited to glass, trim, knobs, panels, racks, tanks, tubs, baskets, structural components, doors, door liners, and shelves;
  3. Plumbing or water supply lines connected to the appliance;
  4. Appliances that have been relocated after service;
  5. Appliances for which replacement parts are no longer available from the manufacturer.

This warranty shall be void in the event Customer has not paid all amounts due under the applicable Service Order.

THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Third-Party / Manufacturer Limitations

Virginia Appliance Repair shall not be responsible for:

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRGINIA APPLIANCE REPAIR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES PROVIDED.

IN ALL EVENTS, VIRGINIA APPLIANCE REPAIR'S TOTAL LIABILITY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CUSTOMER. THIS LIMITATION SHALL NOT APPLY TO CLAIMS FOR PERSONAL INJURY.

Abandoned Work / Parts

If Customer fails to respond, approve work, schedule service, or complete payment within a reasonable time:

Service Documentation

Customer authorizes Virginia Appliance Repair to document service work, including photographs of the appliance and surrounding area, for internal records, warranty claims, and dispute resolution purposes.

Communication Consent

Customer agrees to receive communications from Virginia Appliance Repair, including but not limited to appointment reminders, service updates, invoices, and follow-ups, via phone, text message, and email.

Membership Plans

This section applies specifically to the Home Care, Home Protection Plus, and Estate Membership plans (each, a “Membership Plan”) offered by Virginia Appliance Repair, in addition to the terms above.

Enrollment Fee

A one-time enrollment fee of $49.00 applies to all Membership Plans and is charged at the time of signup, in addition to the first month's membership fee. The enrollment fee is non-refundable once paid, including in the event Customer cancels before receiving any Membership Plan benefits.

Recurring Billing

By enrolling in a Membership Plan, Customer authorizes Virginia Appliance Repair to charge the monthly membership fee to Customer's payment method on file automatically, on a recurring monthly basis, until the membership is canceled in accordance with this Agreement.

Seasonal Scheduling

The annual maintenance visit(s) included with a Membership Plan are scheduled during Virginia Appliance Repair's seasonal service windows (typically spring and fall) rather than on demand. Virginia Appliance Repair will contact Customer to confirm the scheduled date shortly after enrollment. Membership Plan pricing and other benefits, including diagnostic fee reductions and repair discounts, are available immediately upon enrollment and are not subject to this scheduling window.

Membership Benefits

Annual maintenance visits, diagnostic fee reductions or waivers, and repair discounts included with a Membership Plan reset at the start of each membership year and do not carry over. Unused visits, discounts, or diagnostic savings are forfeited at the end of the membership year in which they were earned, and again upon cancellation.

Extended Repair Warranty

Repairs performed while a Membership Plan is active carry an extended labor warranty of six (6) months from the date of service, in place of the ninety (90) day labor warranty described in the Limited Warranty section above. Parts remain covered for the standard ninety (90) days from the date of service, as described in the Limited Warranty section. The extended labor warranty covers the same defect in the same repair only, on the same terms, conditions, and exclusions set out in the Limited Warranty section above, and does not extend to unrelated issues. Membership must remain active for the extended labor warranty to apply; if a Membership Plan is canceled, repairs performed before cancellation revert to the standard ninety (90) day labor warranty measured from the original date of service.

Cancellation

Customer may cancel a Membership Plan at any time by calling (703) 991-6445 or emailing Virginia Appliance Repair, at no cancellation fee. Cancellation takes effect at the end of the then-current monthly billing cycle, and no further monthly charges will be applied after that date. The one-time enrollment fee described above is separate from, and is not affected by, cancellation.

Membership Plan benefits not used prior to the effective date of cancellation, including any unused portion of the annual maintenance visit, are forfeited and are not refundable or transferable.

Entire Agreement

This Agreement, together with the applicable Service Order or Membership Plan enrollment, constitutes the entire agreement between Virginia Appliance Repair and the Customer and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any dispute arising out of or relating to this Agreement shall be resolved exclusively by binding arbitration conducted in Virginia in accordance with applicable arbitration laws.

Damage Waivers

Customer acknowledges that certain services involve inherent risks and agrees to the following waivers:

Appliance Movement

Customer understands that moving appliances may result in damage to the appliance and/or surrounding property, including but not limited to flooring, cabinetry, and countertops. Customer assumes all such risk and agrees to hold harmless Virginia Appliance Repair.

Water-Connected Appliances

Customer acknowledges that appliances connected to water systems present inherent risks of leakage or flooding. Except in cases of gross negligence, Customer agrees to hold harmless Virginia Appliance Repair from any resulting damages.

Cooling Equipment

Customer understands that refrigeration systems may fail unexpectedly and that repairs do not guarantee continued operation. Virginia Appliance Repair shall not be responsible for food spoilage, loss of use, inconvenience, or business losses.

Glass Cooktops

Customer acknowledges that lifting or servicing glass cooktops carries an inherent risk of breakage. Customer assumes all such risk.

By authorizing service, or by enrolling in a Membership Plan, Customer acknowledges that they have read, understood, and agreed to all terms and conditions set forth herein.
